George Birthesel } To all people to whom these presents shall come greeting To } know ye that I George Birthesel of Sutton Township, Meigs Samuel W. Pomeroy } County, Ohio for and in consideration of the sum of eight hundred dollars good and lawful money of the United States of America to me in hand before the ensealing and delivery hereof well and truly paid by Samuel W. Pomeroy the receipt whereof I do hereby acknowledge and am therewith fully satisfied and contented and paid have granted, bargained, sold, aliened, ______ conveyed and confirmed and by these presents do grant, bargain, sell, alien, ____, convey and confirm unto him the said Samuel W. Pomeroy, his heirs and assigns forever all that certain tract, piece or parcel of land situated and described as follows viz being the Northern half of Section ten Range Twelve Town two of the Ohio Company's purchase so known and called containing three hundred and twenty acres be the same more or less being the same tract conveyed by said Pomeroy to said Birthisell by deed dated the twenty forth day of February 1832. To have and to hold the said granted, bargained, and demised premises with all and singular the privileges appurtenances and commodities to the same belonging or in anywise appertaining unto him the said Samuel W. Pomeroy, his heirs and assigns to and for the only proper use, benefit and behoof of him the said Samuel W. Pomeroy, his heirs and assigns forever. The condition of this obligation is such that whereas the said George Birthisell hath this day executed to the said Samuel W. Pomeroy, his note for eight hundred dollars bearing even date herewith payable as follows viz one for two hundred dollars payable on the first day of December 1832, one for two hundred dollars payable on the first day of December 1833, one for two hundred dollars payable on the first day of November 1834. Now if the said George Birthisell shall well and truly pay said Notes as they become due then this obligation and every part thereof to be null and void otherwise to be and remain in full force and virtue in law in testimony whereof I have hereunto set my hand and seal this twenty fourth day of February in the year of our Lord one thousand eight hundred and thirty two the signing, sealing, and delivery acknowledged in presence of us Mary H. Horton } George Birthisell (seal) The State of Ohio } This day personally appeared before me the subscriber one of Gallia County } the Justice of the Peace of the County of Gallia George Birthisell the signer and sealer of the foregoing instrument of conveyance and acknowledged the same to be his free and voluntary act and deed for the purposes therein expressed and I do also further certify that the above named grantor is to me known to be the person whom he represents to be from the representation only of the said S.W. Pomeroy this grantor given under my hand and seal at Gallipolis County of Gallia this twenty fourth day of February AD 1836. J.P.B.
